WHAT ITSS CAN CHECK — THE MOST INSPECTED AREAS

Working hours record

mandatory for all companies since May 2019 (art. 34.9 ET). It must be daily, reliable, and kept for 4 years.

Employment contracts

correct modality, working hours, professional category, and contributions consistent with the actual salary.

Payroll and remuneration

compliance with the Minimum Interprofessional Wage and the minimums of the applicable collective agreement.

Social Security quotes

correct bases, well-applied bonuses, timely registrations and cancellations.

Occupational risk prevention

risk assessment, prevention plan, training, PPE, and health surveillance.

Equality Plan and pay register

mandatory for companies with 50 or more workers.

WHAT ITSS CAN CHECK — THE MOST INSPECTED AREAS

The Labor and Social Security Inspection (ITSS) has competencies over all labor and social security regulations. In practice, these are the areas that generate the most violation reports:

Before: preventive labor audit

The preventive labor audit is the service that saves the most money. We conduct an internal review of all areas that the ITSS can inspect using the same criteria that the inspector applies. We identify non-compliance, quantify the economic risk of each one, and correct them before the inspector arrives. Avoiding a serious penalty is always cheaper than appealing an infringement report.

During: accompaniment and representation

The inspector's visit is not the time to improvise. We are by your side throughout the inspection. We know the rights of the inspected party, we know what documentation to provide and when, and we prevent poorly formulated statements or the delivery of unnecessary documentation from complicating the outcome. The attitude during the inspection directly influences the result.

After: resource for violation records

If the Inspection issues an infringement report, the deadline to submit allegations is 15 business days from its notification. Once the sanctioning file is resolved, an appeal can be made to the Labor Authority and, if necessary, to the contentious-administrative jurisdiction. Many infringement reports are annulled or significantly reduced on appeal when solid and well-documented allegations are presented. In addition to defending you in the present, we work with you to implement policies and procedures that prevent future non-compliance.

Can the Inspection enter my company without prior notice?

Yes. The officials of the Labor Inspection Corps have the authority to conduct visits without prior notice during the company's operating hours (art. 13 of Law 23/2015, Organizing the Labor Inspection System). They are required to identify themselves and communicate the start of the inspection action, but not to announce it in advance.

What documentation do I need to always have available?

Companies must have available at all times: current employment contracts, payrolls from the last 12 months, working time records (mandatory to keep for 4 years), Social Security contribution documentation, labor risk assessment, prevention plan, and if applicable, Equality Plan and harassment protocol. The lack of any of these documents during the inspection is, in itself, an infringement.

What is the deadline for appealing an infringement report from the ITSS?

The deadline to submit allegations against the proposed infringement report is 15 business days from its notification. If after the allegations the Labor Authority confirms the sanction, an appeal can be filed within 1 month, and subsequently a contentious-administrative appeal. The deadlines are strict: missing a deadline equates to losing the right to appeal.

Can the amount of the sanction be negotiated with the ITSS?

There is no direct negotiation regarding the amount, but it is possible to reduce it through a well-founded appeal that supports mitigating factors: absence of previous infractions, immediate rectification of detected breaches, low significance of the breach, or reasonable interpretation of the norm. The LISOS provides a system of degrees (minimum, medium, maximum) that allows for modulation of the sanction within each category.

What is preventive labor auditing and why is it important?

It is an internal review of your company that we carry out using the same criteria applied by the ITSS in its inspections: contracts, records, payroll, quotes, occupational risk prevention, Equality Plan, and protocols. We detect and correct non-compliance before it is detected by the inspector. In most cases, the cost of the preventive audit is significantly lower than the penalty it prevents.
