Noise, capacity and terrace tables: when the cease order arrives

I have been served with a cease order. Does appealing suspend it?
Not on its own. Filing an administrative appeal does not automatically suspend enforcement of the act: suspension has to be requested expressly and with reasons, evidencing the irreparable or hard-to-repair harm enforcement would cause —and in hospitality, closure causes it from day one. So the urgent step is not the written submissions but the suspension request, filed immediately and supported by evidence: staff contracts, committed orders, bookings and the profit and loss account showing what a month closed actually means.
The council has cut the number of tables on my terrace. Can anything be done?
Yes, and there is usually more room than it seems, because these decisions rest on municipal ordinances with measurable criteria: clear pedestrian width, distance to façades and crossings, trees, street furniture. Many reductions rest on a contestable measurement or on a mechanical application of the criterion without weighing the reality of the pavement. The defence is built with your own topographic survey, with the history of previous authorisations and, where appropriate, by requesting suspension of enforcement while it is decided: a season with half the tables is never recovered.
